legal question for 80cm doll

Post by yapplelew47 »

Hey all, I'm a newbie to this forum and will also be my first time on purchasing a love doll and I'm very interested in getting the 80cm Anime doll from DollHouse 168 https://dollto-china.com/doll-house-168 ... anime.html. However there is a concern I have whether it is legal or not to own her in the state California due to her size. I've contacted customs regarding my question but haven't gotten a response yet. Thanks for taking the time to read this and I look forward to your responses.

Hey yapplelew47,

It's absolute ok to have the doll, we've sold quite some to the USA and everything is working perfectly. :)

It is ok at present, however things can change.
The law that would ban child sex dolls has been sitting in senate committee for 16 months as of Oct 7, 2019.

Just keep a watch for similar legislation being proposed in California.
Hopefully you have intelligent lawmakers :)

California... oh boy lol! California is like "alternative central". It's supposed to be the place where out of the norm or "progressive" stuff are allowed. If California says that it's ok to identify as whatever you want, love whoever you want, change your pronouns whenever you feel like it, parade around in super skimpy clothes that barely cover anything while dancing in front of a kid, it would be strange if they suddenly declare cute anime dolls as "evil".

I sure hope the politicians in California are... "smart" so as to prevent the unnecessary pain that would be caused on people who simply adore love dolls and anime.

Anyway, I'm excited for my Shiori to arrive :)

I don't really see anything wrong with this doll, It's basically an oversized anime figurine right?
She doesn't look extremely childish either, especially with those boobs. It's just a scaled down adult anime body I would say.

Although the following will not have any impact on your choice of doll,
the topic: First Anti-Sex Doll Law in American History Goes Into Effect has some strongly expressed feelings about the direction down which some of the world communities are heading.

There was a time when these dolls had some legitimacy in some countries but times and circumstances change.
Take an interest in what your legislators are talking about when it comes to this subject of dolls.
Take it up with your local political representative should the narrative start to show similarity to our experience and subsequent lame-ass laws :)

Wow don't ever do that ... you've already ordered, best to play dumb if someone comes asking. Of all places, California seems pretty damn liberal wrt their sex hobbies.

I've had the same concern. I've been looking at scaled down dolls as a full size is simply impractical and moving around 60+ pounds is too much for me. 2 dolls that caught my eye were https://www.climax-doll.com/products/bb ... a-clm-doll and https://silicone-sexy-doll.com/mini-sex ... doll-white but due to their size I'm not sure about import laws and such. I might have to just go for a torso (which are still more expensive)

A quick primer on the U.S. law as it relates to the topic:

The First Amendment protects expressive activity. Expressive activity includes things like photography, film, and art. Pornography is expressive activity, as is sculpture. A solid argument can be made that sex dolls fall into one or both category. Assuming that argument is valid, the First Amendment applies to sex dolls. (This sounds silly, but it's not.)

Before an expressive activity can be regulated by the government, it must meet fairly demanding standards. Hundreds of attempts to regulate adult bookstores, cinemas, pornography, and "indecent" or "immoral" activities have been struck down as violative of the First Amendment. Restrictions on expressive activity which are "content-based" are presumptively invalid. A content-based restriction is a restriction which is based on the content of the expressive activity. An example would be laws that forbid printing a negative view of the government, or "anti-Christian" messages. The government MAY be allowed to restrict speech in certain circumstances, so long as that restriction is content-neutral. An example would be a ban on leafleting in the interest of controlling litter, not because of the content of the leaflets.

If the government regulation is content-based, it will be deemed unconstitutional UNLESS it falls within a narrow range of previously forbidden categories of historically restricted speech. For purposes of this discussion, the relevant historical category is child pornography. Upholding a 9th Circuit opinion (from California) finding that “censorship through the enactment of criminal laws intended to control an evil idea cannot satisfy the constitutional requirements of the First Amendment,” the U.S. Supreme Court ruled that "virtual" child pornography (pornography that looks like it involves actual children, but doesn't) is not child pornography for purposes of First Amendment analysis. Subsequently enacted statutes have attempted to circumvent or narrow this ruling, but the underlying holding is still good law.

The problem is that when states like TN pass laws directly on this issue (outlawing child-like sex dolls), nobody challenges them, because nobody wants to makes headlines with a Supreme Court case where they argue that they should be constitutionally allowed to have a sex doll that looks like a kid. And if an unconstitutional law is not challenged, it remains the law of the land. Given time, I imagine a challenge to TN law will happen, but only after some poor sot is convicted of violating it, has already had his name drug through the mud, and has nothing left to lose by challenging it.

So all of that is a short way of saying that you probably have a legal right in the United States to own any sex doll you want. But that won't stop overzealous cops and prosecutors from putting you through the ringer in their quest for moral domination if they think it can get them approval from voters. But as far as I can tell, at present TN is the only state in the U.S. with a criminal statute on point.

To Customs, it just looks like a 1:2 (about 3ft) Scale Anime Figure. They may not even think it's a sex doll and just assume it's for photo/collection purposes.

If size was the only thing that stopped dolls, then all dolls would be illegal! Kids would have nothing to play with and anime collectors wouldn't have a collection!
Yet even 1:6 (1ft) or 1:3 (2ft) scale Anime Figures make it through customs just fine! The reason being the big eyes, the overly cartoonish curves, and the fact it's pretty well known in the west that Anime is a thing, they aren't that strict. They can tell a difference between a small anime character and a child-like figure.

In places like Australia they mostly crack down on dolls based on child-like features. Like small breasts, small frame, non existent chin, etc.
However, "Anime" is distinctly filed as, "Fantasy" and therefore isn't adult or child-like. It's just exactly what it is, a creative expressive medium that doesn't abide by either rules.
No normal human being has overly large eyes, really tiny noses, and so on. They'll get the memo that it's just an anime character and think it's a scaled down version (This has been a thing for decades, scaled down anime dolls/figures are everywhere).

To put you more at ease. Think of this doll as an adult body, just scaled down. The big breasts, thicc thighs, wide hips of the 80cm anime doll don't give off any childlike aesthetic. I've amassed a collection of 1:2 and 1:3 scale anime figures from many companies and will be getting a Dollhouse soon for collection purposes. They've all made it through fine!! Customs in California isn't anywhere near as strict as Australia, you'll be fine! :D
